These Terms and Conditions govern the use of the Trip Carver online booking platform and apply to all bookings made through our website. By using our Services and making a booking, you agree to be bound by these Terms, as well as any additional terms listed by individual providers on their product pages.

1. Who We Are

Trip Carver Ltd operates the booking platform available at book.cookislandspocketguide.com, enabling travellers to discover and book tourism products and services.

Each product or service listed is offered by an independent provider, whose name and contact details appear on their respective product page. The provider is responsible for delivering the service. Trip Carver facilitates the booking but is not the provider of the experience unless explicitly stated.

2. Agreement to Terms

By accessing or using our website and booking services, you agree to these Terms and Conditions and to any additional terms set out on the provider's product page.

We may update these Terms from time to time. The current version is always available on our website. Continued use of the website after updates constitutes acceptance of the revised terms.

3. Jurisdiction & Applicable Law

These Terms are governed by the laws of New Zealand and, where relevant, the laws of the country in which the provider operates.

All legal disputes will be resolved in the country of the provider unless otherwise required by law.

4. Provider Terms

Each provider may include additional or specific terms on their product page. These may include, but are not limited to:

  • • Cancellation policies
  • • Age or health restrictions
  • • Minimum group sizes
  • • Refund eligibility conditions

By completing a booking, you agree to those provider-specific terms as well.

5. Booking Process & Responsibilities

Travellers are responsible for:

  • • Carefully reviewing all booking information before confirming
  • • Entering accurate contact details and any relevant travel notes
  • • Notifying the provider directly of any dietary, accessibility or health-related requirements
  • • Arriving on time for tours, check-ins or scheduled services

Changes to bookings must be made directly with the provider, whose contact details are listed on the product page and included in your booking confirmation and reminder emails. All changes are subject to the provider's availability and modification policy.

6. Pricing & Currency

All prices are set by the provider and may vary due to factors like group size, seasonality and exchange rates. Prices are displayed in New Zealand Dollars (NZD), with approximate USD and local currency equivalents shown at checkout for your reference.

The final price payable is confirmed at the time of booking. Some travellers may pay different rates for the same experience due to dynamic pricing, which does not entitle anyone to a refund or price adjustment.

7. Payment

We use a secure third-party payment provider to process all online payments.

Trip Carver does not accept liability for payment complications arising from third-party systems.

8. Cancellations and Refunds

Each provider sets their own cancellation and refund policies, which are displayed on their product pages. These may be stricter than in other regions due to local logistics.

In general:

  • • The booking fee is non-refundable and applies even in weather-related cancellations
  • • No-shows or late arrivals are not eligible for refunds
  • • Refunds must be requested through the provider directly
  • • Trip Carver processes refunds only with provider approval

Cancellation windows and refund conditions are set by each provider and may vary between products. Please refer to the provider's cancellation policy on the product page before booking.

9. Delays, No-Shows & Flexibility

Travellers are expected to arrive on time for:

  • • Tours and activities
  • • Accommodation check-ins
  • • Transfers or transport pick-ups

Providers reserve the right to start or continue services without late arrivals. No compensation or refund is given for missed services.

Tourism in the Pacific is subject to weather and local conditions. Reasonable changes to itineraries, inclusions or schedules may occur. We encourage travellers to stay flexible and understanding.

10. Insurance & Liability

Trip Carver does not provide travel insurance. Travellers are responsible for obtaining their own insurance coverage for cancellations, medical care, property loss and other risks.

You participate in any booked service at your own risk. Trip Carver is not liable for any injuries, damages or losses that occur during a provider's tour or service.

11. Reviews

We encourage travellers to leave reviews to help others make informed decisions. All reviews reflect the personal opinions of the reviewers and do not necessarily reflect the views of Trip Carver.

12. Technical Errors & Pricing Discrepancies

While we strive to keep the platform accurate, technical or human errors may occasionally cause incorrect pricing or product information to be displayed.

In such cases, we reserve the right to cancel a booking and offer the correct price or an alternative.

13. Customs & Etiquette

Travellers are expected to respect the local customs and dress standards of the destination they are visiting. In some locations, conservative attire may be required. Noncompliance may result in denied service without refund.

14. Intellectual Property

All content on this website, including text, images and branding, is the intellectual property of Trip Carver or the respective provider. Reproduction or unauthorised use is prohibited.

15. Charity Donation

1% of all payments made through our platform are donated to local environmental or community-focused charities. You can read more about the causes we support here.

16. Data Protection

17. Force Majeure

Trip Carver and the provider are not liable for cancellations or changes due to events outside of their control, such as natural disasters, political unrest, epidemics or transport disruptions.

18. Dispute Resolution

If you have a problem with a product or service, we encourage you to contact the provider first. If you are unable to reach a resolution, you may contact Trip Carver, and we will do our best to assist.

19. Entire Agreement & Severability

These Terms constitute the entire agreement between you and Trip Carver regarding the use of the platform. If any part of this agreement is found to be invalid, the remaining sections will continue to apply.
